1. Introduction

Welcome to Wallesque. These Terms of Service govern your use of our website and the services provided by Barcodeclothing AS, a company registered in Norway, operating under the brand name Wallesque ("we", "us", "our"). By accessing or using our service, you agree to be bound by these Terms. If you do not agree, please do not use our service.

2. Services Provided

Wallesque provides a platform for generating custom artwork using Artificial Intelligence and printing those artworks on demand. Each product is uniquely generated and printed to your specification. Because AI generation is inherently generative, results may vary and may not perfectly reproduce every detail of your written prompt. By placing an order, you acknowledge and accept this characteristic of AI-generated art.

We reserve the right to refuse, cancel, or remove any generation request or order that we determine, at our sole discretion, to contain illegal content, content that infringes the intellectual property rights of any third party, sexually explicit or offensive material, or content that violates these Terms.

3. Intellectual Property & AI-Generated Content

Upon purchasing an artwork, Wallesque grants you a personal, non-exclusive, non-transferable licence to display the generated image for private, non-commercial purposes. You may not resell, sublicence, or use the artwork for commercial purposes without prior written permission from Wallesque.

You are solely responsible for ensuring that the prompts you submit do not infringe on the copyright, trademark, or other intellectual property rights of any third party. The underlying AI models used to generate images are subject to the terms of their respective providers (including OpenAI and Pollinations). Wallesque makes no warranty regarding ownership of AI-generated outputs beyond the licence described above.

4. Prohibited Uses

You agree not to use our platform to:

• Generate content that is illegal, obscene, sexually explicit, or hateful
• Generate content that infringes the intellectual property or personality rights of any person
• Impersonate any person, brand, or entity
• Automate or scrape our generation service using bots, scripts, or other automated means
• Circumvent or abuse our rate limiting or fraud prevention measures

5. Payments & Pricing

All prices are displayed in Euro (EUR). Payments are processed securely by Stripe, Inc. By completing a purchase, you authorise the charge to your chosen payment method. All sales are final once production has begun. Wallesque is not responsible for currency conversion fees or charges applied by your card issuer.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Wallesque's total liability to you for any claim arising out of or related to these Terms or your use of our services shall not exceed the amount you paid for the specific order giving rise to the claim.

We are not liable for: indirect, incidental, or consequential damages; dissatisfaction with the aesthetic qualities of AI-generated output; colour differences between digital previews and physical prints (which are inherent to the printing process); or delays caused by third-party partners including Gelato and shipping carriers.

7. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by email or by displaying a prominent notice on our website. Your continued use of our services after changes take effect constitutes your acceptance of the revised Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway. The processing of your personal data is governed by the General Data Protection Regulation (GDPR) as implemented in Norwegian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Norway.
